NASHVILLE, Tenn. (WSMV) - When Shelli Hoover was arrested for a DUI on Nov . 19, 2023, it cost her more than just her reputation.

Because her son was in the car with her, she was charged with felony child neglect. As a result, her son was taken away from her for 19 days.

It would take four months for the test results to come back proving she was sober the entire time.

“It was heartbreaking. I never wish for this to happen to anybody else. Ever,” Hoover said.

When she was arrested, Hoover asked to take a breathalyzer to prove she wasn’t drunk on alcohol.

But the police department that arrested her had stopped using breathalyzers.

And WSMV4 Investigates found other sober drivers arrested by departments no longer using breathalyzers.

Even the Tennessee Bureau of Investigation, who conducts blood tests to determine alcohol and drug levels, is confused as to why police aren’t using the devices.
